National perspectives on the CJEU Bayer decision
In the December 2019 edition of Synapse, we wrote about case C-688/17 (the Bayer decision) of the Court of Justice of the European Union (CJEU), which provides guidance on the compensation parties can receive when a patent holder has enforced a preliminary injunction (PI) against them that is later revoked.

Posting workers to Germany after Summer 2020: Bill transposing directive (EU) 2018/957 (current directive for posting workers)
On February 12, 2020 the federal government passed the bill transposing the directive on the posting of workers in the framework of the provision of services. In the future, workers sent to Germany are set to profit more than previously from the work conditions stipulated by German legal and administrative regulations as well as generally binding collective agreements.

Clash of IP and competition to pharma's detriment? The CJEU's decision in the GSK case
On 30 January 2020, the Court of Justice of the European Union (the CJEU or the Court) published its judgment in relation to pay-for-delay settlement agreements1. While other judgments in similar cases are expected soon (for example, in the Servier and Lundbeck appeals2), the Court's decision shows that the CJEU reflects a global trend of legislative and judicial pressure on IP exclusivities in the pharma sector.
