New crowdfunding legislation in the Czech Republic – what does it mean?

Recently, the European Union has adopted several new regulations in the capital markets sector. In April 2022, these regulations were comprehensively implemented into Czech legislation by a draft law amending several financial market acts. This national legislative package aims to transpose these regulations into Czech legislation aiming to integrate the capital markets of EU Member States.

Is it possible to conclude a labour-law contract electronically without complying with the Labour Code's delivery rules?

According to the Supreme Court, it is. In the case under review, a settlement agreement was concluded between the employer and an employee challenging their dismissal by the employer sending a scan of the signed copy of the agreement to the employee in an e-mail attachment, to which the employee's lawyer responded by e-mail confirming that the agreement was approved and signed by the employee.

How much will the major consumer law amendment affect the financial market?

We make no secret of the fact that much of our practice is associated with financial institutions. Therefore, it will not come as a surprise when we start introducing specific changes accompanying a major amendment to consumer law. While it is true that financial institutions will not be affected by most of the major changes in the Civil Code (such as restrictions on telephone contracts), they alone will be limited in the means of distance communication they can use only to those the consumer does not reject. Some means of distance communication, such as payphones, will even require explicit consent.
