The Czech Code of Civil Justice currently in force was passed in 1963, at a time of wildly different social and political circumstances. Many shortcomings have since been successfully removed from the law, but it continues to suffer from the excessive complexity, inconsistencies, and often a lack of clarity of individual provisions.

Are we about to witness the end of the systemic bias defense?
A phenomenon known as "systemic bias of administration", which has long been the subject of discussions, is headed for a solution: a proposed amendment to the Administrative Code wants to abolish the possibility to invoke the defense of systemic bias, with the goal to make the decision-making process of administrative authorities faster and more efficient.

The end of investment arbitrations against the Czech Republic?
On 6 March 2018, the Court of Justice of the European Union (CJEU) ruled that the arbitration clause contained in the Agreement on the Promotion and Reciprocal Protection of Investments concluded between the Czech and Slovak Federative Republic and the Kingdom of the Netherlands is incompatible with European Union law, i.e. that the arbitration clause is inapplicable.
